Warrants

Warrants are governed by regulations as set out in Article 7 of the Miami 21 Code. 

The Warrant permits those Uses listed in Article 4, Table 3 of the Miami 21 Code as requiring a Warrant, upon review by the Planning Director or with the additional review of the Coordinated Review Committee.

The application shall be reviewed for compliance with the Miami 21 Code. The review shall consider the intent of the Transect, the guiding principles of the Miami 21 Code, and the manner in which the proposed use will operate given its specific location and proximity to less intense uses. The review shall also apply Article 4, Table 12, Design Review Criteria, as applicable

As per the Miami 21 Code regulations, the decision on a warrant shall be posted on the City website within five (5) days of the written decision.

Determination of Use

Determinations of Use are governed by Section 7.1.2.2 of the Miami 21 Code. The determination by the Planning Director shall be published on the City website within five (5) days from the date of issuance. Determinations shall become final unless appealed within fifteen (15) calendar business days from the date of publication on the Planning and Zoning Department's website. Appeals shall be filed with the Hearing Boards Office.

Class II Permits (from Zoning Ordinance 11000)

Class II Special Permits are governed by regulations applying to Special Permits generally as set out in Article 13 of the Zoning Ordinance. Class II Special Permits apply to issues related to design, character, and compatibility of a proposed application as specified within different sections of the Zoning Ordinance and the City Code. Where a use is permissible by Class II Special Permit, the purpose of the Class II Special Permit shall be for design review. The governing criteria shall include the applicable criteria and considerations enumerated in Section 1305.2 of the Zoning Ordinance in addition to any other specific criteria and/or considerations that may be set out elsewhere in the City Code, the Zoning Ordinance.
